Service Agreement: Logo Design, Brand Identity, and Website Design Services

Scope of Work
Bellberry Lane specializes in providing highly customized logo design, brand identity, and website design services, tailoring each project according to the unique needs of the client. The specifics of the project, including deliverables, timelines, and expectations, will be clearly defined in the project proposal, order listing, or contract.

Payment
Clients are required to submit a non-refundable deposit before the project initiation. For larger projects like website design, payment can be made in two separate installments, ensuring flexibility for the client. Any remaining balance is due upon the completion of the project and before the final design files are delivered.

Revisions
Clients are entitled to 2 revisions during the design process for logo design and website design services. Any revisions beyond this limit will be accommodated at an additional fee, as mutually agreed upon in the project proposal or contract.

Ownership
Upon receipt of full payment, the client gains complete ownership of the final approved design and all associated files. Bellberry Lane retains the right to showcase the work in its portfolio and marketing materials, highlighting the creative collaboration

Confidentiality
Bellberry Lane is dedicated to maintaining absolute confidentiality. All client information, project-related details, and communication are handled with the utmost discretion and will not be disclosed to any third party without the explicit consent of the client.

Collection of Personal Data
At Bellberry Lane, specific personal data is gathered to enhance your browsing experience and provide tailored services, including your name, business name, business email, phone/mobile number, business mailing address, business social media handles, website address, and payment information. This information is utilized solely for completing logo, branding, and website design projects, ensuring our work aligns seamlessly with your professional identity, and for potential future engagements, enabling the provision of additional services that could benefit your business. Be assured, your privacy and security are our top priorities, and your personal data is handled with utmost care and confidentiality.

Bellberry Lane does not sell any client information to any third-parties.

Refund Policy
Due to the unique and personalized nature of our services, refunds are not offered once the project has commenced. The initial deposit made by the client is non-refundable. If the client decides to cancel the project before its completion, they agree to compensate Bellberry Lane for the work completed up to the point of cancellation, as specified in the project proposal or contract.

Project Timeline
A detailed project timeline will be presented in the initial proposal. Please note any delays caused by late feedback or missing information from the client may extend the project timeline. Timely collaboration is essential to ensure the smooth progress of the project.

Communication
All project-related communication will primarily occur via email, ensuring a detailed and documented record of discussions. Prompt responses from the client are crucial to facilitate effective communication and maintain the momentum of the project.

Abandoned Projects
In the event of no communication or client response for a period exceeding 30 days, the project will be considered abandoned. Clients will be notified of the project's impending abandonment two weeks before marking it as completed, offering a last opportunity to re-engage. If the project is abandoned, a fee of 25% of the project cost may be required to reopen it, depending on the project's complexity and the work completed up to that point. Projects without communication lasting 1 year or more will result in forfeiture of payment, and a new project will need to be initiated if the work is to be resumed. This policy emphasizes the importance of active client engagement throughout the project's duration.

Originality
Bellberry Lane guarantees the originality of all design work provided, affirming that the designs created do not infringe upon the intellectual property rights of any third party.

Client Materials
For website design projects, the client is responsible for providing necessary materials such as images and text. The client affirms that they possess the appropriate rights and permissions to use these materials in their project, ensuring compliance with legal requirements.

Liability
Bellberry Lane is not responsible for any damages, whether direct, indirect, incidental, special, or consequential, including but not limited to, loss of profits, business interruption, or loss of data, arising from the use or inability to use the design work provided. The client acknowledges that they are solely responsible for evaluating the suitability and compatibility of the delivered design work for their intended purposes. This includes ensuring that the designs meet their specific requirements and objectives. By proceeding with the project, the client accepts full responsibility for the outcomes resulting from the use of the provided design work.

Fonts used in Bellberry Lane's design projects are licensed materials subject to usage terms defined by font foundries or creators. Bellberry Lane acquires licenses for specific client projects, but the fonts remain under the ownership and terms of the respective creators.

Client Responsibility
Clients are responsible for obtaining licenses if they wish to use the fonts in additional materials beyond the original project scope. Bellberry Lane provides guidance on proper licensing procedures and can assist in recommending alternative fonts if needed.

Web Hosting and Domain
Clients are responsible for securing their domain name and hosting services. Bellberry Lane can provide recommendations and assist with the setup if required. Clients are solely responsible for the costs associated with hosting and domain registration.

Upon the website's completion and launch, Bellberry Lane will provide assistance for up to two weeks, if required. Limited technical support related to the website's functionality will be provided for a specified period after the launch as detailed in the description for the purchased web design services package. Additional support beyond this period may incur additional charges at an hourly rate.

Client Responsibilities
Clients are responsible for providing all necessary content, including text, images, and multimedia elements, unless content creation services are included in the project agreement. Clients must also ensure they have the legal rights to use any materials they provide for the website. Clients are also responsible for their website's maintenance, updates, and any associated costs after the project is completed.

Bellberry Lane provides comprehensive website design services tailored to your specific needs as outlined in the project scope. Any items, features, or services requested beyond the agreed-upon project scope, including third-party integrations, will incur additional charges. Payment for any extra features not outlined in the proposal/contract is due upfront, with work beginning upon payment receipt. Clients are responsible for clearly expressing their needs and understanding the provided cost.
